Punitive damages are typically awarded when a jury finds that the actions of a person in causing injury to another person is so outrageous or reckless that the jury imposes a punishment to the person on top of awarding damages for compensation. In Connecticut, punitive damages are limited to Attorney’s Fees and Costs.
However, in certain situations involving recklessness in causing an injury in a car accident, a jury can double or triple the award for compensation. The law, Connecticut General Statute section 14-295, is very specific about the type of conduct that might entitle an injured person to double or treble damages. For example, the law allows double or treble recovery where the person who caused the injury was driving under the influence or traveling at a recklessly high rate of speed.
